Frequently asked questions

Does judicial incapacitation still exist?+

Not as it once did. Since the 2021 reform the system is built on supporting the person's will rather than replacing it. Older rulings must be reviewed to bring them into line with the current model.

What is self-appointed curatorship?+

It means stating in a public deed who you want to support you and how, in case you ever need it. It is one of the most reassuring decisions you can take with time to spare.

Do you always have to go to court?+

No. Many support arrangements are set up before a notary. Only when there is no agreement, or the situation demands it, do we go to court — and then it is prepared with expert reports and with the person's own wishes at the front.
